The Legal Responsibility Argument

This argument goes as follows:

The vendor claims that if there is a mishap relating to the fire alarm system that they installed, they could be held liable legally since their name is on the product and all other parts that go with the system. Hence, the database that they created to support the installed system cannot be turned over to the cuastomer for obvious liability reasons. You can see that this is also usable as a ploy to pressurize the customer into a service contract with the vendor and in fact is used extensively. Here is a couple of problems with this:

The typical customer has plenty of insureance for the entire site. They certainly have to be protecteed against al kinds of mishaps not just the fire system realated mishaps and their management is fully aware of this and this protection is typicall in place.

If you look at the fine print on the vendor liability in the service contract you will typically find a clause to the effect that the responsibility of the vendor shall be limited to the actual or replacement cost of the hardware and may not have any mention of any other liability insurance.

But this argument is used extensively for commercial purposes. This is also applied to other aspects of a fire alarm system such as the qualified installers and serfvice persons required and their training requirements. But this is part of the larger problem of barriers to competition and business entry and there will always be more and more of these for profit and gain reasons and the argumets cited will be very clever and will appear to make ample sense. We are not going to address this problem.
